Welcome to Victory A&P. These Terms of Service ("Terms") govern your use of our website victoryap.org and our aviation maintenance certification preparation services. By accessing or using our services, you agree to be bound by these Terms.

1. Services Description

Victory A&P provides online educational services designed to prepare eligible military veterans and active duty personnel for FAA Airframe and Powerplant (A&P) certification examinations. Our program includes:

• Online instructor-led coursework
• Study materials and practice tests
• Exam preparation resources
• Eligibility assessment assistance

Important: Victory A&P is an exam preparation program. We do not guarantee certification, exam passage, or employment. Certification is granted solely by the FAA upon successful completion of required examinations administered by designated examiners.

2. Eligibility Requirements

To enroll in our program, you must:

• Be at least 18 years of age
• Be a U.S. military veteran or active duty service member
• Meet FAA experience requirements under 14 CFR 65.77 (30 months for both certificates or 18 months for a single certificate)
• Provide valid military documentation (DD-214, service records) verifying aviation maintenance experience

Enrollment is contingent upon eligibility verification. We reserve the right to refuse or cancel enrollment if eligibility requirements are not met.

3. Account Registration

To access our services, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Payment and Refund Policy

Payment: The program fee is $3,495 USD, payable in full at enrollment or through approved payment plans. All payments are processed securely through Stripe.

Refund Policy:

• Before Program Start: Full refund available if requested before your cohort start date
• Within First 7 Days: Full refund available within 7 days of program start if you have completed less than 20% of course materials
• After 7 Days: No refunds will be issued after the first 7 days or after completing more than 20% of course materials
• Eligibility Denial: Full refund if we determine you do not meet FAA eligibility requirements

5. Intellectual Property

All content on our website and within our program—including text, graphics, logos, videos, course materials, and software—is the property of Victory A&P or our licensors and is protected by copyright and intellectual property laws.

You may not:

• Copy, reproduce, or distribute our materials without permission
• Share your account access or course materials with others
• Use our content for commercial purposes
• Remove any copyright or proprietary notices

6. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose
• Share, sell, or transfer your account to another person
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Submit false or misleading information
• Engage in cheating or academic dishonesty
• Harass or harm other users or our staff

Violation of these terms may result in immediate termination of your account without refund.

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• Our services will meet your specific requirements
• Our services will be uninterrupted, timely, or error-free
• You will pass FAA examinations or obtain certification
• You will obtain employment in the aviation industry

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VICTORY A&P SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use our services
• Failure to pass FAA examinations
• Unauthorized access to your account
• Any third-party conduct or content

Our total liability shall not exceed the amount you paid for our services.

9. Indemnification

You agree to indemnify and hold harmless Victory A&P, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

10. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use our services will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Florida.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
